These Terms & Conditions govern your use of the Effective Presentations website and your purchase or use of services offered by Effective Presentations Inc. By using this website, registering for a workshop, purchasing coaching, or engaging Effective Presentations for training services, you agree to these Terms & Conditions.
1. About Effective Presentations
Effective Presentations Inc. provides presentation skills training, public speaking training, communication training, corporate workshops, live virtual training, executive coaching, 1-on-1 coaching, and related professional development services. References to “Effective Presentations,” “we,” “us,” or “our” in these Terms mean Effective Presentations Inc.
2. Written Agreements Control
If you have a signed proposal, training agreement, statement of work, order, or nondisclosure agreement with Effective Presentations, that written agreement controls if it conflicts with these Terms or with information on our website. This applies to payment terms, cancellation and rescheduling, travel arrangements, confidentiality, and dispute resolution for private and corporate training.
Purchases made through our GSA Schedule contract are governed by that contract, which controls over these Terms.
3. Training and Coaching Services
Program descriptions, schedules, locations, instructors, pricing, and availability are subject to change. We make reasonable efforts to provide accurate information on our website.
Training exercises, examples, coaching recommendations, and course materials are provided for professional development and educational purposes. Results vary based on the participant, organization, situation, and application of the material.
4. Registration and Payment
Payment is due according to the terms shown during registration or checkout, or in the applicable proposal or agreement. A registration is not guaranteed until any required payment has been received and the registration has been confirmed.
5. Cancellations, Rescheduling, Transfers, and No-Shows
Open-enrollment workshops and 1-on-1 coaching sessions are subject to our Cancellation and Rescheduling Policy, which is part of these Terms. That policy explains cancellation deadlines, rescheduling fees, substitutions, transfers, no-shows, and what happens if Effective Presentations cancels or reschedules a program. Private and corporate training engagements follow the cancellation and rescheduling terms in the applicable proposal or agreement.
6. Workshop Changes and Trainer Assignments
Effective Presentations may make reasonable changes to workshop schedules, training locations, delivery format, or trainer assignments when circumstances require. Our trainers use a consistent training methodology, but individual trainers may use different examples, exercises, coaching approaches, or facilitation techniques.
If we cancel or materially reschedule an open-enrollment workshop, the options available to registered participants are described in the Cancellation and Rescheduling Policy.
7. Live Virtual Training
For live virtual training, you are responsible for a working internet connection, audio, and access to the video platform we use, and for a camera where the program calls for one. You are also responsible for joining on time. We are not responsible for technical problems on your side. If a problem on our side prevents us from delivering a program, the “If we cancel or reschedule” section of the Cancellation and Rescheduling Policy applies.
8. Travel and Related Expenses
Participants are responsible for their own travel, lodging, transportation, meals, and other personal expenses for attending an open-enrollment workshop unless we expressly state otherwise. Effective Presentations is not responsible for losses related to participant travel arrangements when a workshop is cancelled, rescheduled, relocated, or otherwise changed. We encourage you to review your travel booking terms before you book.
9. Training Materials and Intellectual Property
All course materials, participant manuals, frameworks, exercises, worksheets, videos, slides, graphics, training methods, and other materials provided by Effective Presentations are protected by applicable intellectual property laws. Unless we give written permission, training materials are provided for the personal or internal business use of the participant or client and may not be:
- Resold or commercially distributed
- Reproduced for use in another training program
- Published online or made publicly available
- Modified and represented as the work of another person or organization
- Used to create or deliver a competing training product or service
Participants may use the skills, concepts, techniques, and completed worksheets from the training in their own professional work.
10. Recording Workshops and Coaching Sessions
Participants may not record, livestream, photograph for distribution, or otherwise reproduce a workshop or coaching session without prior permission from Effective Presentations.
We video record participants’ practice presentations during our presentation skills workshops so that participants can review their delivery and receive feedback. We may also use video during other programs as part of the coaching process. Video recorded for practice and feedback is used for training purposes. Any separate use of participant images, recordings, testimonials, or likenesses for marketing purposes will be handled according to the applicable consent or release.
11. Participant Conduct
Effective Presentations is committed to a professional and productive learning environment. We may remove a participant from a workshop, coaching session, or other program for conduct that materially disrupts the program, threatens or harasses another person, damages property, or prevents the trainer from effectively delivering the program. Removal for serious misconduct may result in forfeiture of registration fees.
12. Confidentiality
Participants may discuss business situations, presentation challenges, workplace examples, or other information during exercises and discussions. Participants are expected to respect the confidentiality of information voluntarily shared by other participants. For private coaching or corporate engagements involving confidential or proprietary information, specific confidentiality obligations are governed by the applicable agreement or nondisclosure agreement.
13. Website Content
The information on this website is provided for general informational purposes. We may update, modify, remove, or correct website content at any time. Although we make reasonable efforts to keep information accurate, we do not guarantee that every page will always be complete, current, or error-free. If you believe information about a workshop, price, date, or service is incorrect, please contact us before making travel arrangements or relying on that information.
14. Third-Party Services and Links
Our website may contain links to third-party websites, payment processors, video platforms, registration systems, scheduling services, or other outside services. Effective Presentations does not control third-party websites or services and is not responsible for their content, availability, privacy practices, security, or terms. Your use of a third-party service may also be governed by that provider’s terms and policies.
15. Privacy
Your use of this website is also subject to the Effective Presentations Privacy Policy, which describes how we collect, use, and handle personal information associated with website visits, inquiries, registrations, and other interactions with us.
16. No Guarantee of Specific Results
Our programs are designed to help participants improve communication, presentation, public speaking, messaging, and related professional skills. Individual results vary. Effective Presentations does not guarantee a particular business result, career outcome, sales result, promotion, speaking opportunity, financial result, or other specific outcome from participating in training or coaching.
17. Disclaimer of Warranties
To the extent permitted by law, the website and its content are provided on an “as available” basis. Effective Presentations does not warrant that the website will operate without interruption or error or that all content will remain continuously available. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
18. Limitation of Liability
To the extent permitted by applicable law, Effective Presentations will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of the website or participation in our programs. To the extent permitted by applicable law, our total liability for any claim related to a program or service will not exceed the amount you paid to Effective Presentations for that program or service. Nothing in these Terms limits liability that cannot legally be limited or excluded.
19. Governing Law and Venue
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute concerning these Terms will be brought in the state or federal courts located in Jefferson County, Colorado, unless a separate written agreement between the parties provides otherwise.
20. Changes to These Terms
We may update these Terms periodically to reflect changes in our services, business practices, technology, or legal requirements. When we make changes, we will update the effective date shown on this page. The Terms in effect when you register or purchase apply to that registration or purchase. Updated Terms apply to later registrations and purchases and to your continued use of the website.
